IS IT LEGAL TO GROW CBD LEGAL CANNABIS IN SWITZERLAND?

Yes it is possible, but there are some things to take into consideration before you start growing legal CBD cannabis plants in your garden or balcony! Let’s see what there is to take into consideration:

Personal use

Does the law change depending on the canton you live in?

Yes, federal law is very open on the subject, giving each canton the opportunity to legislate according to its own points of view.

For example, the canton of St. Gallen requires companies and individuals to notify the cultivation of more than ten plants, while other cantons such as the cantons of Vaud, Ticino, Bern or have no limitation in this sense.

Our best advice is to find out about the law currently in force within the canton where you want to promote cultivation, by contacting the interested parties, to find out how the issue of growing CBD plants for personal use is addressed.

In Ticino the control office responsible for this matter is the Weapons, Explosives and Private Security Service, 6512 Giubiasco.

Even though the law is very open, it doesn’t mean you can do anything you put your mind to.

Can hemp with a THC content higher than 0.99% be grown in Switzerland?

No, according to current law it is not possible, even for personal use, to grow your own THC cannabis at home. In no canton of Switzerland.

Unlike if there is a medical prescription for the treatment of a specific pathology, limited self-production is also permitted.

Please note: Hemp plant seeds with a THC content higher than 9.99% are also illegal on Swiss soil.

What variety to grow?

There are many variables to take into consideration: from the southern exposure (time of exposure to the sun), from the location where you intend to grow, from the type of cultivation you intend to do (outdoor, greenhouse and/or indoor), from the taste personal (terpene profile) and much more.

How can the authorities verify and communicate the THC content of the plants I grow?

Thanks to the rapid tests supplied to the cantonal police, this data can only be obtained when the plant is flowering.

By choosing CBD and/or CBG legal hemp genetics, the risk of exceeding the maximum THC level allowed in Switzerland (0.99%) is zero.

So why not opt for clean production without problems?

This is the link to the current federal law on the subject and the various guidelines:

Federal law basis (admin.ch)

Growing for personal use or commercial use?

Normally those who produce for personal use do so for themselves, consequently the number of plants grown and the relative weight of dried female inflorescences will be limited. In this case, considering the THC content is lower than the maximum limit allowed on Swiss soil (0.99%), there will be no problem.

For commercial players who wish to produce a larger quantity of goods, a notification is required to the relevant control office: Weapons, Explosives and Private Security Service, 6512 Giubiasco.

Federal legal basis in brief

As of January 1, 2011, the production of hemp with a THC content of less than 0.99% is permitted in Switzerland.

The entire plant including flowers is not considered a narcotic (THC less than 0.99%).

There are many applications for this change of vision way back in 2011.

The main sectors of use are: food, textiles, raw materials, construction, environment, smoking.

Switzerland has decided to relaunch a supply chain already widely considered in the past, allowing people and companies to operate again with the industrial hemp plant.

Conclusion

The Hemp plant and its parts (THC less than 0.99%) are therefore considered like any other food product, there is no longer a distinction (at a federal level) between the cultivation of Hemp (THC less than 0.99%) and the cultivation, for example, courgettes or salad (formentino).

The ground is fertile for personal and corporate operations in a historical moment where the reference to origins and simple things is now increasingly indispensable.

It is a pleasure to operate in a sector in which you deal with people who cultivate the land, touch the products first hand and see their final appreciation.
